Terms and Conditions

• Custom Your Padel: the trading name of Bodegraven & Wilffert Enterprise, based in the Netherlands.
• Customer: the natural person or legal entity who enters into an agreement with Custom Your Padel.
• Product: a custom padel racket, personalised to the customer’s specifications.
• Agreement: any arrangement between Custom Your Padel and the customer for the supply of a product.

These terms and conditions apply to all offers, orders and agreements of Custom Your Padel. Any deviation from them is valid only if agreed in writing.

An agreement is concluded once the customer has completed their design in the online designer, placed the order and the payment has been received. For business orders, approval of the quote is sufficient, after which the order is delivered and invoiced.

Custom Your Padel starts finishing the product immediately on receipt of the order. If Custom Your Padel notices anything unclear in the submitted design, it will contact the customer before production starts. If the customer wants to make a change to the design, they indicate this in the notes during the ordering process, before the order is placed.

All prices are in euros and include VAT unless stated otherwise. Prices may change without prior notice, but orders that have already been placed and confirmed remain at the agreed price.

Private customers pay in advance using one of the payment methods offered. Business customers pay by invoice within 14 or 30 days, as agreed.

Custom Your Padel aims to deliver private orders within 7 working days and business orders within 7 to 14 working days, counted from the day the order is placed and (where applicable) payment is received.

We deliver throughout Europe. Shipping costs vary by country and are shown at checkout before you pay. For deliveries outside the European Union, the destination country’s import duties and VAT may apply; these are payable by the recipient.

Custom Your Padel is not liable for delays caused by external parties such as carriers, unless the delay is due to intent or gross negligence on the part of Custom Your Padel.

Because all products are personalised to the customer’s specifications, they are excluded from the statutory right of withdrawal under Article 6:230p(f) of the Dutch Civil Code.

For this reason, Custom Your Padel takes care to check the submitted design before production starts. If the customer sees any reason to make a change, they indicate this before the order is placed.

As a rule, Custom Your Padel does not take personalised rackets back. If the customer would nevertheless like a solution for a reason other than a production or delivery error, Custom Your Padel will consider this case by case. No rights can be derived from this. In the event of a production or delivery error, the warranty in Article 7 continues to apply in full: the customer is entitled to repair, replacement or a refund.

Custom Your Padel provides a warranty of 12 months against defects in materials and printing under normal use. Normal use means use that is consistent with the nature of the product (recreational padel play).

The warranty does not cover:

• Wear and tear caused by intensive use.
• Damage caused by improper use, accidents or misuse.
• Damage caused by inadequate maintenance.

Custom Your Padel is liable only for direct loss resulting from intent or gross negligence on the part of Custom Your Padel. In all cases, liability is limited to the invoice value of the order concerned.

Custom Your Padel is not liable for consequential loss, loss of profit, lost savings or other indirect loss.

The customer warrants that they are entitled to have the submitted design or logo printed on the product. Custom Your Padel is not liable for claims by third parties relating to the intellectual property in submitted files.

Custom Your Padel may use images of delivered products in its own marketing, unless the customer has objected to this in writing beforehand.

Any complaint about a delivered product must be reported within 7 days of receipt by email to info@customyourpadel.nl. Custom Your Padel will respond within 5 working days and will aim to find a suitable solution.

All agreements are governed exclusively by Dutch law. Disputes will be brought before the competent court in the district in which Bodegraven & Wilffert Enterprise is established.

These terms and conditions are a translation of the Dutch original. In the event of any doubt about their interpretation, the Dutch version prevails.
